        AN ACT to amend the civil practice law and rules,  in  relation  to  the
          limitation for actions based on breach of a contract for home improve-
          ments
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Subdivision 2 of section 213 of the civil practice law  and
     2  rules, as amended by chapter 709 of the laws of 1988, is amended to read
     3  as follows:
     4    2.  an  action  upon a contractual obligation or liability, express or
     5  implied, except as provided in section two hundred  thirteen-a  of  this
     6  article  or  article  [2]  two of the uniform commercial code or article
     7  [36-B] thirty-six-B of the general business law, provided however,  that
     8  an  action  based  on  breach  of contract for home improvements must be
     9  commenced within six years or six months from the date of  discovery  of
    10  the breach, whichever is later;
    11    §  2.  This  act shall take effect on the thirtieth day after it shall
    12  have become a law.
