Subdivision 6 of section 60.05 of the penal law, as amended 2 by chapter 410 of the laws of 1979, is amended to read as follows: 3 6. Multiple felony offender. When the court imposes sentence upon a 4 second violent felony offender, as defined in section 70.04, or a second 5 felony offender, as defined in section 70.06, the court must impose a 6 sentence of imprisonment in accordance with section 70.04 or 70.06, as 7 the case may be, unless it imposes a sentence of imprisonment in accord- 8 ance with section 70.08, 70.09, or 70.10. ________ 9  2. Paragraph (a) of subdivision 1 of section 70.04 of the penal law, 10 as added by chapter 481 of the laws of 1978, is amended to read as 11 follows: 12 (a) A second violent felony offender is a person, other than a preda- _____________________ 13 tory sex offender as defined in section 70.09, who stands convicted of a ______________________________________________ 14 violent felony offense as defined in subdivision one of section 70.02 15 after having previously been subjected to a predicate violent felony 16 conviction as defined in paragraph (b) of this subdivision. 17  3. Paragraph (a) of subdivision 1 of section 70.06 of the penal law, 18 as amended by chapter 410 of the laws of 1979, is amended to read as 19 follows: EXPLANATION--Matter in italics (underscored) is new; matter in brackets _______ [ ] is old law to be omitted. LBD01144-01-7 A. 416 2 1 (a) A second felony offender is a person, other than a second violent 2 felony offender as defined in section 70.04 or a predatory sex offender ___________________________ 3 as defined in section 70.09, who stands convicted of a felony defined in ___________________________ 4 this chapter, other than a class A-I felony, after having previously 5 been subjected to one or more predicate felony convictions as defined in 6 paragraph (b) of this subdivision. 7  4. Paragraph (a) of subdivision 3 of section 70.08 of the penal law, 8 as amended by chapter 3 of the laws of 1995, is amended to read as 9 follows: 10 (a) For a class B felony, the minimum period must be at least twenty 11 years and must not exceed twenty-five years, provided, however, that _________________________ 12 where a sentence is imposed upon a person for a class B felony offense ________________________________________________________________________ 13 defined in section 130.35, 130.50, 130.70, or 130.80 in which the victim ________________________________________________________________________ 14 of such offense is less that seventeen years of age and one or more of ________________________________________________________________________ 15 the predicate violent felony convictions is of one of the foregoing ________________________________________________________________________ 16 offenses in which the victim of such offense is less than seventeen ________________________________________________________________________ 17 years of age, the minimum period must be fixed by the court at twenty- ________________________________________________________________________ 18 five years; __________ 19  5. The penal law is amended by adding a new section 70.09 to read as 20 follows: 21  70.09 Sentence of imprisonment for predatory sex offender. ____________________________________________________________ 22 1. Definition of predatory sex offender. (a) For purposes of this ______________________________________________________________________ 23 section, the term "predatory sex offense" means an offense defined in ________________________________________________________________________ 24 section 130.35, 130.50, or 130.70 of this chapter where the victim of ________________________________________________________________________ 25 such offense is less than seventeen years of age, or section 130.30, ________________________________________________________________________ 26 130.45, subdivision three of section 130.65, paragraph (c) of subdivi- ________________________________________________________________________ 27 sion one of section 130.67, section 130.75, or section 130.80 of this ________________________________________________________________________ 28 chapter. ________ 29 (b) A predatory sex offender is a person who stands convicted of a ______________________________________________________________________ 30 predatory sex offense after having previously been subjected to a predi- ________________________________________________________________________ 31 cate felony conviction as a result of a conviction in this state for a ________________________________________________________________________ 32 predatory sex offense or in any other jurisdiction of an offense ________________________________________________________________________ 33 containing all of the essential elements of a predatory sex offense. ____________________________________________________________________ 34 (c) For purposes of determining whether a person has a predicate ______________________________________________________________________ 35 predatory felony conviction, the criteria set forth in subparagraphs ________________________________________________________________________ 36 (ii) through (vi) of paragraph (b) of subdivision one of section 70.06 ________________________________________________________________________ 37 shall apply. ____________ 38 2. Authorized sentence. (a) When the court has found, pursuant to the ______________________________________________________________________ 39 provisions of the criminal procedure law that a person is a predatory ________________________________________________________________________ 40 sex offender, the court must, except as otherwise required in paragraph ________________________________________________________________________ 41 (b) of this subdivision, impose a determinate sentence of imprisonment ________________________________________________________________________ 42 which shall be in whole or half years, the term of which must be fixed ________________________________________________________________________ 43 by the court for a period of at least ten years and not to exceed twen- ________________________________________________________________________ 44 ty-five years, provided that, where the court finds on the record that ________________________________________________________________________ 45 the history and character of the defendant and the nature and circum- ________________________________________________________________________ 46 stances of his criminal conduct indicate that extended incarceration and ________________________________________________________________________ 47 life-time supervision is necessary to safeguard society, the court may ________________________________________________________________________ 48 instead impose an indeterminate sentence of imprisonment, the maximum ________________________________________________________________________ 49 term of which shall be life imprisonment and the minimum period of ________________________________________________________________________ 50 imprisonment a period fixed by the court of at least twenty years and ________________________________________________________________________ 51 not to exceed twenty-five years. ________________________________ 52 (b) In any case in which a person found to be a predatory sex offender ______________________________________________________________________ 53 stands convicted of an offense defined in section 130.35, 130.50, ________________________________________________________________________ 54 130.70, or 130.80 in which the victim of such offense is less than ________________________________________________________________________ 55 seventeen years of age and the predicate violent felony conviction is of ________________________________________________________________________ 56 one of the foregoing offenses in which the victim of such offense is ________________________________________________________________________ A. 416 3 1 less than seventeen years of age, the court must impose an indeterminate ________________________________________________________________________ 2 sentence of imprisonment, the maximum term of which shall be life impri- ________________________________________________________________________ 3 sonment and the minimum term of imprisonment which shall be a period of ________________________________________________________________________ 4 twenty-five years. With respect to any offender who would receive a ________________________________________________________________________ 5 longer sentence of imprisonment if sentenced otherwise than pursuant to ________________________________________________________________________ 6 this section such offenders shall receive such longer sentence, notwith- ________________________________________________________________________ 7 standing the provisions of this section. ________________________________________ 8  6. The civil practice law and rules is amended by adding a new 9 section 214-e to read as follows: 10  214-e. Actions based on childhood sexual abuse or exploitation. 1. ______________________________________________________________________ 11 All claims or causes of action brought by any person for recovery of ________________________________________________________________________ 12 damages for injury or condition suffered as a result of childhood sexual ________________________________________________________________________ 13 abuse or exploitation shall be commenced within three years of the act ________________________________________________________________________ 14 alleged to have caused the injury or condition, or three years from the ________________________________________________________________________ 15 time of discovery by the injured party of both the injury and the causal ________________________________________________________________________ 16 relationship between the injury and the childhood sexual abuse or ________________________________________________________________________ 17 exploitation, whichever period expires later; provided that the time ________________________________________________________________________ 18 limit for commencement of an action under this section shall be tolled ________________________________________________________________________ 19 for an infant until the infant reaches the age of twenty-one years. ___________________________________________________________________ 20 2. The injured party need not establish which act, in a series of ______________________________________________________________________ 21 continuing acts of childhood sexual abuse or exploitation caused the ________________________________________________________________________ 22 injury or condition that is the subject of the suit. The injured party ________________________________________________________________________ 23 may compute the date of discovery from the date of discovery of the last ________________________________________________________________________ 24 act by the same perpetrator. ____________________________ 25 3. The knowledge of a custodial or noncustodial parent or guardian ______________________________________________________________________ 26 shall not be imputed to an infant. __________________________________ 27 4. As used in this section, "childhood sexual abuse or exploitation" ______________________________________________________________________ 28 means any act committed by the perpetrator against the injured party ________________________________________________________________________ 29 which act occurred when the injured party was an infant and which act ________________________________________________________________________ 30 would have been proscribed by article one hundred thirty of the penal ________________________________________________________________________ 31 law, or which act would have constituted incest as defined in section ________________________________________________________________________ 32 255.25 of the penal law, or which act would have constituted the use of ________________________________________________________________________ 33 a child in a sexual performance as defined in section 263.05 of the ________________________________________________________________________ 34 penal law, or which act would have violated any prior laws of this state ________________________________________________________________________ 35 of similar effect at the time the act was committed. ____________________________________________________ 36 5. This section applies to all causes of action commenced on or after ______________________________________________________________________ 37 the effective date of this section, regardless of when the cause of ________________________________________________________________________ 38 action arose, and shall also be deemed to revive any cause of action ________________________________________________________________________ 39 which was or would have been barred because the applicable statute of ________________________________________________________________________ 40 limitation had expired prior to such date. __________________________________________ 41  7. Subdivision 2 of section 70.10 of the penal law, as amended by 42 chapter 481 of the laws of 1978, is amended to read as follows: 43 2. Authorized sentence. When the court has found, pursuant to the 44 provisions of the criminal procedure law, that a person is a persistent 45 felony offender, and when it is of the opinion that the history and 46 character of the defendant and the nature and circumstances of his crim- 47 inal conduct indicate that extended incarceration and life-time super- 48 vision will best serve the public interest, the court, in lieu of impos- 49 ing the sentence of imprisonment authorized by section 70.00, 70.02, 50 70.04 [or], 70.06 or 70.09 for the crime of which such person presently _ ________ 51 stands convicted, may impose the sentence of imprisonment authorized by 52 that section for a class A-I felony. In such event the reasons for the 53 court's opinion shall be set forth in the record. Notwithstanding the ___________________ 54 provisions of this section, a court may not impose upon a person a ________________________________________________________________________ 55 sentence of imprisonment authorized pursuant to this section where the ________________________________________________________________________ A. 416 4 1 sentence of imprisonment imposed upon such person pursuant to section ________________________________________________________________________ 2 70.09 as a predatory sex offender would exceed such sentence. _____________________________________________________________ 3  8. This act shall take effect immediately, provided, however, that 4 sections one through five and section seven of this act shall take 5 effect on the first day of November next succeeding the date on which it 6 shall have become a law and shall apply only to offenses occurring on or 7 after such date, and provided further, however, that the amendments made 8 to paragraph (a) of subdivision 3 of section 70.08 of the penal law by 9 section four of this act shall not affect the expiration and reversion 10 of such paragraph as provided by subdivision d of section 74 of chapter 11 3 of the laws of 1995, as amended and shall be deemed to expire there- 12 with.
