The civil practice law and rules is amended by adding a new 2 section 4548 to read as follows: 3  4548. Compromise and offers to compromise. Evidence of (a) furnish- ______________________________________________________________________ 4 ing or offering or promising to furnish, or (b) accepting or offering or ________________________________________________________________________ 5 promising to accept, any valuable consideration in compromising or ________________________________________________________________________ 6 attempting to compromise a claim which was disputed as to either validi- ________________________________________________________________________ 7 ty or amount, shall not be admissible to prove liability for or invalid- ________________________________________________________________________ 8 ity of such claim or such amount. Evidence of conduct or statements made ________________________________________________________________________ 9 in compromise negotiations shall likewise not be admissible. The ________________________________________________________________________ 10 provisions of this section shall not require the exclusion of any ________________________________________________________________________ 11 evidence otherwise discoverable merely because it is presented in the ________________________________________________________________________ 12 course of compromise negotiations.
