    AN  ACT  to  amend  the  civil  practice  law  and rules, in relation to
      personal service upon a corporation or governmental subdivision
      The People of the State of New York, represented in Senate and  Assem-

    bly, do enact as follows:
    _________________________
 1    Section  1.  Subdivision  (b) of section 311 of the civil practice law
 2  and rules, as added by chapter 337 of the laws of 1996,  is  amended  to
 3  read as follows:
 4    (b)  If  service  upon  a  domestic or foreign corporation [in time to
 5  secure and file the proof of service called for by subdivision  (a)  of]
 6  within  the  one  hundred  twenty  days allowed by section three hundred
    __________________________________________________
 7  six-b of this article is impracticable under paragraph one  of  subdivi-
 8  sion  (a) of this section or any other law, service upon the corporation
 9  may be made in such manner, and proof of service may take such form,  as
10  the court, upon motion without notice, directs.
11     2. This act shall take effect immediately.
