AN ACT to amend the civil practice law and rules, in relation to the
fees of stenographers
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
1 Section 1. The legislature finds that a collective bargaining agree-
2 ment relating to the format of court transcripts and payment therefor
3 has been negotiated by the unified court system with employee organiza-
4 tions representing certain nonjudicial officers and employees in the
5 following collective negotiating units: Nassau county, New York city
6 administrative, librarian, clerical and support, New York city court
7 reporters, ninth judicial district, and Suffolk county. The purpose of
8 this act is to implement this agreement.
9 S 2. Notwithstanding any other provision of law, the chief administra-
10 tor of the courts shall adopt rules which shall govern the format of
11 each page of a transcript of court proceedings to be furnished by a
12 court reporter who is an employee in a collective negotiating unit spec-
13 ified in section one of this act and the rate of payment to which he or
14 she is entitled therefor.
15 S 3. This act shall not enlarge or diminish or otherwise have any
16 impact upon the responsibility of the unified court system to pay for
17 transcripts furnished by a court reporter.
18 S 4. No rules adopted pursuant to section two of this act, governing
19 payment for transcripts furnished by court reporters, shall be effective
20 for nonjudicial officers and employees in a collective negotiating unit
21 specified in section one of this act until the chief administrator of
22 the courts shall deliver to the comptroller a certificate that there is
23 in effect with respect to such negotiating unit a written collective
24 bargaining agreement with the state pursuant to article 14 of the civil
25 service law which provides therefor.
26 S 5. Section 8002 of the civil practice law and rules, as amended by
27 chapter 846 of the laws of 1984, is amended to read as follows:

1 S 8002. Stenographers. Unless otherwise {agreed or} provided by law, a
2 stenographer is entitled, for a copy fully written out from his OR HER
3 stenographic notes of testimony or other proceedings taken in a court,
4 and furnished upon request to a party or his OR HER attorney, to the fee
5 set forth in the rules promulgated by the chief administrator of the
6 courts.
7 S 6. This act shall take effect immediately; provided, however, the
8 provisions of section 8002 of the civil practice law and rules, in
9 effect immediately prior to the effective date of this act, shall remain
10 in full force and effect as to nonjudicial officers and employees of the
11 unified court system in a collective negotiating unit as to which the
12 rules adopted pursuant to section two of this act are not effective.
